Who these terms are between

These Terms of Sale govern the purchase of Formula 1900 Advanced Revitalizing Powder from US ExoTech LLC, a Delaware limited liability company of 16192 Coastal Highway, Lewes, Delaware 19958 (“we”, “us”), through the website www.usexotech.net.

By placing an order you agree to these terms. Please read them before you buy; they set out what you are entitled to and what we are responsible for.

Who may buy

Formula 1900 is sold for professional topical use only. By placing an order you confirm that:

• You are at least 18 years old and legally able to enter into a contract
• You are a licensed skincare or aesthetic professional, or are purchasing on behalf of a practice or business that employs one
• You will use the product in accordance with the enclosed instructions, applicable law, and the terms of your own professional license

We may decline or cancel any order where we are not satisfied that these conditions are met, and we may ask for evidence of a professional credential before shipping.

The product

Formula 1900 Advanced Revitalizing Powder is a cosmetic product. It is supplied as a single-use lyophilized powder, 1.5 g net weight, in one sealed glass vial per box, reconstituted with 3 mL of sterile water or saline immediately before topical application.

It is not for injection. It is not a drug and not a medical device. It is not intended to diagnose, treat, cure or prevent any disease, and no therapeutic or medical benefit is claimed. Individual results vary.

Product images on this website are representative. Packaging, labelling and lot-specific information may be updated over time; the enclosed instruction card and carton labelling govern the product you receive, and should be read before use.

Price and taxes

The price is US $2,000.00 per vial, stated in United States dollars. Prices are exclusive of any sales, use or excise tax, which will be added at checkout where we are required to collect it, and exclusive of shipping unless stated otherwise at the time of order.

We may change prices at any time. The price that applies to your order is the price displayed when you place it.

Orders and acceptance

Your order is an offer to buy, not a completed contract. A confirmation that we have received your order does not amount to acceptance of it. A contract is formed only when we send you a dispatch confirmation, or otherwise expressly accept your order in writing.

We may decline an order for any lawful reason, including where the product is unavailable, where there has been a pricing or description error, where we cannot verify your professional status, or where we suspect fraud. If we decline an order after taking payment, we will refund it in full.

Payment

Card payments are processed by Stripe. We do not receive or store your card details. Where we accept payment by bank transfer, the order is held until cleared funds are received, and we will confirm receipt to you.

Payment must clear in full before an order ships. Title to the goods and risk of loss pass to you on delivery to the address you gave us.

Shipping and delivery

We ship to United States addresses only. We do not ship internationally, and we do not ship to freight forwarders.

The product is shipped at ambient temperature; no cold chain is required. A signature is required on delivery. Please give an address where someone can receive the parcel during business hours — a practice or business address is usually best.

Delivery estimates given at the time of order are estimates and not guarantees. Once a carrier has delivered to the address you supplied and obtained a signature, delivery is complete.

If we cannot ship in 30 days

Where we cannot ship your order within 30 days of receiving your properly completed order and payment, we will notify you, tell you the revised shipping date, and give you the choice of consenting to the delay or cancelling for a full and prompt refund. If you do not respond to a delay notice, we will cancel the order and refund you. This reflects our obligations under the U.S. Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule.

Returns and refunds

Unopened, undamaged boxes may be returned within 14 days of delivery. To start a return, email admin@usexotech.net within that period with your order reference. We will confirm the return and give you a return address. Please do not send anything back before we confirm it.

Once a vial has been opened it cannot be returned. This is a sterile single-use cosmetic product; once the seal is broken we cannot verify its condition or resell it. Boxes returned with a broken seal, a missing vial or damage caused after delivery will not be refunded.

How refunds are made

• Refunds are issued to the original method of payment. We cannot refund to a different card or account.
• We will process the refund within 10 business days of receiving the returned goods and confirming their condition.
• Your bank or card issuer may take several further days to show the credit; that part is outside our control.
• The refund covers the price you paid for the goods. Original shipping charges are refunded only where the return is the result of our error or a defective product.
• Return shipping is at your cost, unless the item was damaged, defective or incorrectly supplied, in which case we pay it.

We recommend returning goods by a tracked, insured service. Until we receive them, they remain your responsibility.

Damaged or incorrect items

Inspect your order on arrival. If the vial is broken, the seal is compromised, or the wrong item has been supplied, email admin@usexotech.net within 7 days of delivery with photographs of the outer carton, the packaging and the item. We will replace the product or refund it in full, including shipping, at your choice. Nothing in this section limits any right you have under applicable law.

Suspected adverse reactions or other product safety concerns should be reported to safety@usexotech.net as soon as possible, whether or not you are seeking a refund.

Cancellation

You may cancel an order at no cost at any time before it is dispatched by emailing admin@usexotech.net. If it has already shipped, treat it as a return under the section above.

Professional use and resale

You are responsible for using the product in accordance with its labelling and instructions, for the professional judgment applied in your practice, and for compliance with the licensing, health and safety rules that apply where you operate.

You may not resell, repackage, relabel, dilute, decant or otherwise alter the product, or represent it as anything other than the cosmetic product described on its labelling, without our prior written agreement.

Warranty and disclaimers

We warrant that the product will, at the time of delivery, conform to the description and specification published on this website and on its labelling, and will have been handled and stored properly while in our control.

To the fullest extent permitted by law, and except as expressly stated in these terms, the product is supplied without any other warranty of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose. We make no claim as to any therapeutic, medical or clinical outcome, and none should be inferred.

Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the product giving rise to the claim. We are not liable for indirect, incidental, special or consequential losses, including loss of profit, loss of business, or loss of goodwill.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

Governing law

These terms and any dispute arising from them are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and both you and we submit to that jurisdiction.

General

These terms, together with the information on the order page and the confirmation we send you, are the entire agreement between us regarding your purchase. If any provision is found unenforceable, the rest continues to apply. Our failure to enforce a provision is not a waiver of it. We may update these terms at any time; the version in force when you place your order is the version that governs it.
